Report to Assembly concerning referral
If the ICAC has reported to the ICAC Minister or a Minister and either:
- the Minister to whom the report was made provides a written response to the ICAC; or
- the Minister to whom the report was made does not provide a written response within a reasonable time;
and the Commissioner is not satisfied with the Minister's response (if any), the Commissioner may make a report on the referral:
- to an Assembly Committee; or
- if there is no Assembly Committee – to the Speaker.
The report may contain as much information as the Commissioner considers appropriate. It must contain a fair representation of any response provided by the minister.
The report may also contain recommendations.
The Chairperson of an Assembly Committee or the Speaker must table a copy of the report in the Legislative Assembly within six sitting days after receipt of the report.
