If the ICAC has made a report to a Minister or the ICAC Minister and either:

  • the Minister to whom the report is made provides a written response to the ICAC; or
  • the Minister to whom the report is made does not provide a written response within a reasonable time;

and the ICAC is not satisfied with the minister's response (if any), he may make a report on the referral:

  • to the Assembly Committee; or
  • if there is no Assembly Committee – to the Speaker.

The report may contain as much information as the ICAC considers appropriate in relation to the referral. It must contain a fair representation of any response provided by the minister.

The report may also contain recommendations.

The chairperson of the Assembly Committee or the Speaker must table a copy of the report in the Legislative Assembly within six sitting days after the chairperson or Speaker receives the report.
