As the result of an investigation, the Commissioner or the Commissioner's delegate can:
- prepare a report
- make findings of improper conduct
- provide a brief of evidence to a law enforcement agency, such as the NT Police or the NT Director of Public Prosecutions (DPP) to investigate or for consideration of a prosecution
- provide a brief of evidence to the person responsible for the public officer or public body to determine whether disciplinary action should be taken
- make recommendations to the relevant public body, minister or the Chief Minister.
The ICAC cannot prosecute people. Prosecution is a matter for NT Police or the NT DPP.
If a risk of improper conduct is identified in an organisation, measures can be recommended to better educate and/or reduce the risks of impropriety. This includes:
- working with public bodies to strengthen policies
- developing guidelines that inform public bodies
- providing education resources to increase understanding about preventing and detecting improper conduct.
