What is an investigation report?

The Commissioner may make a report about an investigation to a responsible authority. If the report does not relate to an MLA the Commissioner can publish the report if it is appropriate to do so.

The investigation report can include:

  • as much information as the Commissioner considers is appropriate for the matter
  • findings about whether a public body or public officer has engaged, is engaged, or may engage, in improper conduct.
  • Information about whether a matter has been or should be referred
  • Include recommendations

A published investigation report must not identify any person if it amounts to no more than misconduct or unsatisfactory conduct unless it gives rise to a suspicion of systemic conduct, or other exceptional circumstances exist that make it appropriate to identify the person.
