If the Commissioner holds a public inquiry, he must make an investigation report after it has finished.
If he proposes to make an adverse finding against a person or body in an investigation report, that person or public body must be given a reasonable opportunity to respond before the report is published. The response must be fairly reported in the public inquiry report.
An investigation report in relation to a public inquiry can:
- contain as much information as the Commissioner thinks is appropriate
- include findings on whether the person or public body involved has engaged in improper conduct
- include recommendations and detail whether the allegation will be referred to another agency or authority for further action.
The Commissioner may publish the report if it is appropriate to do so.
