What happens to my report?

The ICAC Act empowers the Commissioner to investigate cases of corrupt conduct and anti-democratic conduct and refer cases of misconduct and unsatisfactory conduct to referral entities to investigate. However, under the ICAC Act there are some limited occasions where the Commissioner can exercise discretion to deal with misconduct and unsatisfactory conduct.

When you make a report, the Commissioner, or the Commissioner’s delegate, will decide what action will be taken.

  1. Acknowledge
    • Assuming you have provided contact information, you will receive written acknowledgement of your report containing a reference number.
  2. Review and triage
    • Your report will be assessed.
  3. Decision
    • Your report will be dealt with in one of the following ways:
      • referral to another agency for action
      • investigation or review
      • taking no action:
        • where the matter has already been dealt with
        • if it happened a long time ago and the ability to collect evidence is compromised
        • if the matter is outside jurisdiction
        • or if it is otherwise not in the public interest to take action.
