The ICAC may make media statements about investigations or other activities if appropriate.

Information for the media

The Commissioner will not generally comment on operational matters, including whether a report has been received, unless he considers it is in the public interest to do so.

Journalists should consider the impact that publishing confidential information may have on the Commissioner’s ability to investigate improper conduct and protect whistleblowers, and on the reputation of people under investigation.

Journalist privilege

If a journalist or their employer does not wish to answer a question or produce a document because it will identify an informant, a claim for privilege can be made following the procedure set out in Part 5, Division 2 of the ICAC Act.

Only the Supreme Court can determine a claim for privilege under section 127A of the Evidence (National Uniform Legislation) Act 2011.
